Owner responsibilities: Owners who want to lease their lot have many specific timing and reporting requirements prior to the lease and subsequent to the lease. Noncompliance can result in denial of the lease request, termination of an existing lease, and/or fines.
Lease requirement: All leases shall be in writing and in a form approved by the Board prior to the effective date of the lease. Each owner leasing his or her unit should include a provision in the lease stating that the lessee acknowledges that he or she has received and read the Declaration of Covenant, By-Laws, and Rules and Regulations of the Association.
Addendum to Lease requirement: The Addendum to Lease must be attached to the Lease; it is signed by both the owner and lessee acknowledging their responsibilities and agreeing to our Governing Documents.
Authorized leasing: Owners may lease their lots only if they have obtained a Leasing Permit or Hardship Leasing Permit from the Association. The lot can not be leased if:
- that lease would exceed the leasing cap of 16, or
- the owner has not occupied the lot as his or her primary residence for a total of at least 12 months prior to the request for a Leasing Permit.
General leasing provisions: Transient occupancy, short-term leasing, and arrangements such as Airbnb or VRBO are prohibited. All leases must be for an initial term of not less than 180 days. Lots may be leased only in their entirety.
Recreational facilities: In the event that a lot is leased to a tenant with rights to use the recreational facilities of the neighborhood, the owner of such lot gives up privileges to the recreational facilities during the time of that lease.
